Last month, on the 15 June 2012, the South African Minister of Labour issued a revised Code of Good Practice on HIV and AIDS and the World of Work in terms of the Employment Equity Act 55 of 1998: as published in GN 451 in Government Gazette 35435.
The preamble emphasises that the Code, in line with the ILO recommendation No. 200, provides for further emphasis on the fundamental human rights of all workers, including the principle of gender equality and the broadening of the scope to cover all those involved in the world of work.
The Code provides guidelines to develop workplace policies and programmes eliminating unfair discrimination, promoting access to education and managing HIV and AIDS in the workplace.
Employers may need to reconsider related company policies to ensure they remain aligned with the Code and it is recommended such policies be reviewed.
